- Your use of our Services is not subject to the GDPR or similar EU/EEA data protection regulations
We reserve the right to restrict access to our Services based on geographic location and to terminate accounts that violate these geographic restrictions.
3. Description of Services
TrustML provides a platform that enables businesses to access multiple AI services through a unified interface with enterprise-grade security, compliance, and cost management features. Our Services include:
- Access to third-party AI models (e.g., Claude, ChatGPT, Gemini)
- Data protection and filtering capabilities
- Usage monitoring and cost tracking
- Administrative controls and user management
4. Account Registration
To use our Services, you must create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Keep your password confidential and secure
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use
We reserve the right to suspend or terminate accounts that violate these Terms.
5. Acceptable Use
You agree to use our Services only for lawful purposes and in accordance with these Terms. You agree NOT to:

Our Services provide access to AI models operated by third parties (e.g., Anthropic, OpenAI, Google). Your use of these AI models is subject to the respective provider's terms of service and acceptable use policies.
We are not responsible for:
- The content, accuracy, or quality of AI-generated outputs
- Changes to third-party AI services or their availability
- Third-party terms or policies
You acknowledge that AI outputs may contain errors and should be reviewed before use in critical applications.
7. Fees and Payment
7.1 Pricing
Our current pricing is available on our website. Fees consist of:
- Platform fees (per workspace and per active user)
- AI usage costs (passed through at cost based on actual consumption)
7.2 Billing
You agree to pay all fees according to the billing terms in effect at the time. Platform fees are billed monthly in advance; AI usage costs are billed monthly in arrears based on actual usage.
7.3 Taxes
Fees are exclusive of applicable taxes. You are responsible for paying all taxes associated with your use of the Services.
7.4 Changes to Pricing
We may change our fees upon 30 days' notice. Continued use after a price change constitutes acceptance of the new pricing.
8. Free Trials
We may offer free trials of our Services. Free trials are subject to these Terms. We may modify or discontinue trial offerings at any time. At the end of a trial, you will be charged unless you cancel before the trial expires.
9. Intellectual Property
9.1 Our Intellectual Property
The Services, including all content, features, and functionality, are owned by TrustML and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the Services in accordance with these Terms.
9.2 Your Content
You retain ownership of content you submit through the Services ("User Content"). You grant us a limited license to process User Content as necessary to provide the Services. We do not claim ownership of your User Content.
9.3 Feedback
If you provide feedback or suggestions about our Services, we may use this feedback without obligation to you.
10. Data Protection
Our data practices are described in our Privacy Policy. Key commitments:
- Your data is never sold
- Your data is never shared for third-party marketing
- Your data is never used to train AI models
You are responsible for ensuring your use of the Services complies with applicable data protection laws and regulations.
11. Confidentiality
Each party agrees to keep confidential any non-public information received from the other party. This does not apply to information that is publicly available, independently developed, or rightfully obtained from third parties.
12. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. WE DO NOT WARRANT THE ACCURACY OR COMPLETENESS OF AI-GENERATED OUTPUTS.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRUSTML SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO TRUSTML IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
14. Indemnification
You agree to indemnify and hold harmless TrustML and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:
- Your use of the Services
- Your violation of these Terms
- Your violation of any third-party rights
- Your User Content
15. Termination
You may terminate your account at any time by contacting us. We may suspend or terminate your access to the Services at any time for violation of these Terms or for any other reason with notice.
Upon termination:
- Your right to use the Services immediately ceases
- You remain liable for any outstanding fees
- Provisions that by their nature should survive termination will survive
16. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and, where appropriate, by email. Your continued use of the Services after changes constitutes acceptance of the modified Terms.
17. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court for intellectual property matters.

- Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
